The Bowerbird Method™

Terms of Use

1. Definitions

In these Terms of Use, the following definitions apply:

  • “Website” means bowerbirdmethod.com and related subdomains, together with any storefront, scorecard or checkout pages operated for The Bowerbird Method™.

  • “User” means any person accessing or using the Website.

  • “Services” means all services, features and content provided on the Website, including the sale and delivery of digital products.

  • “Cyber PR” means Cyber PR Pty Ltd (ACN 664 009 143).

  • “Products” means the downloadable digital products published under The Bowerbird Method™, including the Playbook and the Complete Implementation System.

  • “User Content” means any text, images, feedback or other materials submitted by Users.

2. User eligibility

Users must be at least 16 years old. By accessing the Website, you represent that you meet this age requirement.

3. The Products are educational materials, not a consultancy service

The Products are downloadable educational and implementation materials published by Cyber PR. They are designed to transfer knowledge so that you can apply the process yourself. Purchasing or using the Products does not create a consulting, advisory or client relationship with Cyber PR, and the Products are not professional, legal or financial advice.

4. Licence and intellectual property

All content on the Website, including code, design, text and graphics, is owned by Cyber PR or its licensors. Your use of the Products is governed by the separate End User Licence Agreement for The Bowerbird Method™, which sets out who may use the Products free of charge and what is and is not permitted. In summary, an SME may use the Products for its own communications work, and a small agency of fewer than 15 people may use them to deliver client work, but no User may resell, redistribute, repackage, sublicense or present the Method as another entity’s proprietary system. Where the End User Licence Agreement and these Terms differ in relation to the Products, the End User Licence Agreement prevails.

5. Acceptable use

Users agree not to:

use the Website for unlawful activities;

  • upload viruses, malware or spam;

  • attempt to gain unauthorised access to any part of the Website;

  • infringe any third-party rights.

6. Purchases, delivery and refunds

Products are delivered digitally, with access generally provided immediately after purchase. Because access is delivered immediately, digital purchases are generally non-refundable, except where a refund is required by law or where the files supplied are materially defective or inaccessible. This refund position is also shown before checkout. If you experience a problem accessing a Product, contact hello@cyberpr.com.au and we will work to resolve it.

7. User Content

Users retain ownership of their User Content but grant Cyber PR a worldwide, royalty-free licence to use, reproduce and display such content in connection with the Services. Cyber PR may remove User Content that violates these Terms. For takedown requests, contact hello@cyberpr.com.au.

8. Disclaimers and liability

The Services and Products are provided “as is” without warranties, to the maximum extent permitted by law. Nothing in these Terms excludes any consumer guarantee or right that cannot lawfully be excluded, including under the Australian Consumer Law. Results are not guaranteed: the Method is an educational and planning system, and outcomes depend on the quality of the User’s inputs, decisions, evidence, implementation, market conditions and many other organisational factors.

To the maximum extent permitted by law, Cyber PR’s liability is capped at AUD 1,000 or the total fees paid by the User in the prior 12 months, whichever is greater. Users agree to indemnify Cyber PR against any claims arising from their misuse of the Services or breach of these Terms.

9. Force majeure

Cyber PR will not be liable for any failure to perform due to events beyond its reasonable control, including natural disasters, cyberattacks or government actions.

10. Privacy

Your use of the Website is also governed by our Privacy Policy, available at bowerbirdmethod.com.

11. Amendments

Cyber PR may update these Terms at any time. Significant changes will be notified via website banner or email. Continued use after notice signifies acceptance.

12. Termination

Cyber PR may suspend or terminate access for Users who breach these Terms or for inactivity. Upon termination, User licences to access the Website end, although the End User Licence Agreement continues to govern Products already lawfully downloaded, subject to its own terms.

13. Governing law and dispute resolution

These Terms are governed by the laws of New South Wales, Australia. Disputes shall first be referred to mediation; if unresolved, to the courts of that State.
