End User Licence Agreement

Effective date: 29 June 2026

1. About this Agreement

‍ This End User Licence Agreement (the “Licence”) is a legal agreement between you (the “Licensee”, “you” or “your”) and Cyber PR Pty Ltd (ACN 664 009 143) (“Cyber PR”, “we”, “us” or “our”), the publisher of The Bowerbird Method™. By downloading, accessing or using the Materials, you agree to be bound by this Licence. If you do not agree, do not download or use the Materials.

2. Definitions

  • ‍ “The Bowerbird Method™ ” or the “Method” means the proprietary communications operating framework published by Cyber PR, including its three rules, three maturity stages, defined sequence and supporting structure.

  • “Materials” means the downloadable products published under the Method, including the Playbook, the complete Implementation System, prompts, templates, working documents, diagrams, blueprints and any accompanying written guidance, in any tier or edition.

  • “Your Organisation” means a single organisation that you own, operate, study in, volunteer for or are directly employed by.

  • “Small Agency” means a communications, marketing, public relations or consulting business that employs fewer than fifteen (15) people (counting all employees, contractors and principals).

  • ‍ “SME” means a small or medium-sized enterprise using the Materials for its own communications activities rather than to provide services to third parties.

  • ‍“Commercial Exploitation” means reselling, redistributing, repackaging, sublicensing, publishing, or presenting the Method, its sequence, templates or any substantial adaptation of them as a product, service, course, software, platform or proprietary system of any person or entity other than Cyber PR.

3. Grant of Licence

Subject to your continued compliance with this Licence, Cyber PR grants you a worldwide, royalty-free, non-exclusive, non-transferable and revocable licence to use the Materials as set out below. This Licence is granted free of additional charge to the categories of Licensee described in clause 4.

4. Who may use the Materials free of charge

‍The free Licence in clause 3 is available to:

  • an SME, having purchased The Method and then using the Materials for its own internal communications work; and

  • a Small Agency (fewer than 15 people), including for the purpose of delivering communications work to its own clients.

Any organisation that does not fall within one of these categories — including an agency, consultancy or firm of fifteen (15) people or more — must obtain a separate written commercial licence from Cyber PR before using the Materials.

5. What you may do

Within the scope of clause 4, you may:

  • use, copy and adapt the Materials for your own learning and for communications work;

  • ‍apply the Method to the communications activities of Your Organisation;

  • where you are a Small Agency, apply the Method when delivering communications services to your clients; and

  • ‍share the Materials internally, on a reasonable basis, with colleagues working on the same organisation’s communications.

6. What you may not do

You may not, whether for payment or not:

  • resell, publicly redistribute, repackage or sublicense the Method, its sequence, templates or any substantial adaptation of them;

  • present the Method or a substantial adaptation of it as another person’s or entity’s proprietary system, methodology, product or framework;

  • use the Materials to build, train, document or operate a competing product, course, software, platform or branded methodology;

  • remove, obscure or alter any proprietary notice, attribution or branding within the Materials; or

  • engage in any Commercial Exploitation of the Materials.

For clarity, a Small Agency delivering client work under clause 5 is using the Method to perform services; it is not licensed to sell, license or hold out the Method itself as the agency’s own product or proprietary system. Commercial consulting, agency, software, course or platform use of the Method as a product requires the prior written permission of Cyber PR.

7. Ownership and intellectual property

The Method and the Materials are owned by Cyber PR and are protected by copyright and other intellectual property laws. Except for the limited rights expressly granted in this Licence, all rights are reserved. Nothing in this Licence transfers ownership of any intellectual property to you. Adaptations you create for permitted use do not give you any ownership of the underlying Method.

8. No professional advice and no guarantee of results

The Materials are educational and planning resources. They are not consulting, legal, financial or professional advice, and using them does not create any advisory or client relationship with Cyber PR. Outcomes depend on the quality of your inputs, decisions, evidence, implementation, market conditions and many other organisational factors. Cyber PR does not warrant or guarantee any particular result.

9. Disclaimers and limitation of liability

The Materials are provided “as is” and “as available”, without warranties of any kind to the maximum extent permitted by law. Nothing in this Licence excludes, restricts or modifies any consumer guarantee or right that cannot lawfully be excluded, including under the Australian Consumer Law.

To the maximum extent permitted by law, Cyber PR’s total aggregate liability arising out of or in connection with the Materials or this Licence is limited to AUD 100 or, where the Materials were purchased, the amount you paid for them, whichever is greater. Cyber PR is not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, data or goodwill.

10. Termination

This Licence applies for as long as you comply with it. It terminates automatically if you breach any term, in particular clause 6. On termination you must stop using the Materials and destroy all copies in your possession or control, except where retention is required by law. Clauses 7, 8, 9 and 12 survive termination.

11. Changes to this Licence

Cyber PR may update this Licence for future downloads of the Materials. The version in force at the time you download the Materials governs your use of that download.

12. Governing law

‍This Licence is governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of that State. Disputes should first be raised with Cyber PR and, where possible, referred to mediation before any court proceedings.
